Administrative liability for illegal crossing of the border of Ukraine

Citizens of Ukraine and foreigners are obliged to comply with the rules of border crossing, which are clearly established by law. In case of violation of these rules and illegal border crossing, administrative liability may arise under Article 204-1 of the Code of Administrative Offenses.
Illegal border crossing is a departure abroad outside the border service checkpoints or through a checkpoint, but on the basis of forged documents or without permission from the relevant authority.

For example, it is illegal to leave with a forged passport of a citizen of Ukraine or on the basis of a forged conclusion of the Military Service Committee on unfitness for military service with exclusion from military registration, etc. The actions of a person in the form of crossing the border through natural barriers and terrain outside the checkpoints also fall under the signs of an offense.
In the case of illegal border crossing, liability may arise under Article 204-1 of the Code of Administrative Offenses:
Crossing or attempting to cross the state border of Ukraine by any means outside the checkpoints across the state border of Ukraine or at checkpoints across the state border of Ukraine without appropriate documents or using a forged document or one containing inaccurate information about the person, or without permission from the relevant authorities - entail a fine of two hundred to five hundred tax-free minimum incomes of citizens (3,400-8,500 UAH) or administrative arrest for a term of up to fifteen days, with confiscation of the tools and means of committing the offense.
If an offense is detected, the Border Guard Service of Ukraine or the National Police of Ukraine may draw up a report on the commission of an administrative offense, which is sent for consideration to the local court at the place of commission of the offense.
