Foreigners and stateless persons who are legally present on the territory of Ukraine are obliged to strictly comply with national laws and regulations on crossing the state border, legalization and the period of stay in the country. Violation of such rules and regulations may lead to negative consequences, including the imposition of a ban on entry into Ukraine by state authorities.
A ban on entry into Ukraine is a written decision in the form of a resolution from a state body, which is transmitted to the State Border Service of Ukraine. Such a decision prohibits a foreigner from entering the country for a period of 3, 5 or 10 years due to violation of national rules and regulations.
The following state bodies may make decisions on banning entry into Ukraine:- The Security Service of Ukraine (SBU) - due to the presence of information about the threat of a foreigner's stay on the territory of Ukraine to national security, defense, public order or in connection with the fight against terrorism.
- The State Migration Service of Ukraine (SMS) - due to the absence of residence permits in Ukraine, non-execution of court decisions, the presence of unfulfilled property obligations to the state, individuals or legal entities (fines, enforcement proceedings, etc.).
- The State Border Guard Service of Ukraine (SBSU) - due to the provision of false information or documents when crossing the border, illegal border crossing outside checkpoints, violation of the procedure for entry and exit from the temporarily occupied territory of Ukraine, etc.
- The National Police of Ukraine - due to violation of public order, national security, threat of terrorism or non-execution of court decisions on the territory of Ukraine.
State bodies authorized to impose a ban on entry into Ukraine prepare a certificate with information about the foreigner and the grounds for imposing the ban. The decision on the ban is made in the form of a resolution. A copy of the resolution together with the order is sent to the State Border Service of Ukraine to enter information about the ban into the database. When attempting to cross the border, the border service may stamp the passport document with an entry ban.
